Kwixx Pty Ltd ABN 97 640 186 563 trading as Kwixx (“we”, “us” or “our”) recognises the importance of privacy and is committed to protecting your privacy when handling your personal information.  We handle personal information for purposes relating to making available priority and related services for purchase through our Kwixx application (“Kwixx App”) on behalf of organisations (“Kwixx Partners”) who have registered on our Kwixx website www.kwixx.com (“Kwixx Site”) as providers of these services.  These priority and related services may be purchased through our Kwixx App by customers of our Kwixx Partners who have registered on our Kwixx App.
This Privacy Policy describes how we collect, hold, use and disclose personal information in an open and transparent manner for purposes relating to providing our Kwixx App, Kwixx Site and related services (“Kwixx Services”).  This Privacy Policy applies to all personal information that we collect about users of our Kwixx Services including customers who purchase through our Kwixx App priority or related services from our Kwixx Partners, representatives or our Kwixx Partners who make available and manage priority or related services which may be purchased through our Kwixx App, and other persons who contact us to enquire about our Kwixx Services.  In this Privacy Policy a reference to “personal information” means any information about an identified or reasonably identifiable natural person.
By providing us with your personal information you consent to us collecting, holding, using and disclosing it in accordance with this Privacy Policy.  If you revoke your consent to us collecting, holding, using or disclosing your personal information in accordance with this Privacy Policy then we may not be able to provide you with our Kwixx Services.  If you provide us with any personal information about another person then we rely upon you to inform that person of the details contained in this Privacy Policy.

If you are a customer or representative of one of our Kwixx Partners then we may collect, hold, use and disclose your personal information for the following purposes:

  • evaluating and improving our Kwixx Services

If you are a customer of one of our Kwixx Partners then the kinds of personal information about you that we may collect and hold include:
  • user profile information including your name, email, password, favourites, location and credit card details
  • service information including services purchased and payment details
If you are a representative of one of our Kwixx Partners then the kinds of personal information about you that we may collect and hold include your user profile information including your name, email, password and organisation details.
If you contact us to enquire about our Kwixx Services then the kinds of personal information about you that we may collect and hold include your contact details including your name, email address and mobile number.
In all cases the kinds of personal information about you that we may collect and hold include your communications information including your message content, date and time.
If you do not provide us with any personal information that we request then we may not be able to provide you or your organisation respectively with our Kwixx Services.

We may use cookies and similar technologies to collect information about your use of our Kwixx Site and Kwixx App.

We use Google Analytics to collect and hold information about your visits to our Kwixx Site which is stored by Google on its servers in the United States.  We use the information collected by Google about your visits to our Kwixx Site for the purpose of maintaining and improving our Kwixx Site and enhancing your experience browsing our Kwixx Site.

If you are a customer or representative of one of our Kwixx Partners then we may collect your personal information directly from you when:
  • you register to use or use our Kwixx Services
  • you request us to provide you with assistance or support for our Kwixx Services
  • you request us to provide you with information about our Kwixx Services
  • you complete a survey or provide feedback in respect of our Kwixx Services
  • you subscribe to receive news or other information about our Kwixx Services
  • you enter our competitions or promotions
If you contact us to enquire about our Kwixx Services then we may collect your personal information directly from you at that time.
Third party collection
We may also collect your personal information from third parties for purposes relating to providing our Kwixx Services.
If you are a customer of one of our Kwixx Partners then we may collect your personal information from:
  • your representative in connection with providing you with our Kwixx Services
  • our Kwixx Partners in connection with any priority or related services that you have purchased through our Kwixx App from them
If you are a representative of one of our Kwixx Partners then we may collect your personal information from your organisation in connection with providing your organisation with our Kwixx Services.
In all cases we may collect your personal information from our service providers that assist us to provide our Kwixx Services including information technology providers, payment gateway providers, data analytics providers, and sales and marketing providers.

6. When you will have the option of not identifying yourself

We will give you the option of not identifying yourself or using a pseudonym when dealing with us in relation to a particular matter except where it is impracticable or unlawful for us to do so.  You may not need to identify yourself when you request that we provide you with general information about our Kwixx Services.

We may disclose your personal information to third parties for purposes relating to providing our Kwixx Services.
If you are a customer of one of our Kwixx Partners then we may disclose your personal information to:
  • your representative in connection with providing you with our Kwixx Services
  • our Kwixx Partners in connection with any priority or related services that you have purchased through our Kwixx App from them
If you are a representative of one of our Kwixx Partners then we may disclose your personal information to your organisation in connection with providing your organisation with our Kwixx Services.
In all cases we may disclose your personal information to:
  • our service providers that assist us to provide our Kwixx Services including information technology providers, payment gateway providers, data analytics providers, and sales and marketing providers
  • our related companies, agents, affiliates and other trusted entities that assist us to provide our Kwixx Services
  • government departments and agencies in connection with providing our Kwixx Services
  • our professional advisers including consultants, accountants and lawyers in connection with providing our Kwixx Services

You may request access to, correction of, and deletion of any of your personal information which we hold that you are unable to access, correct or delete using our Kwixx App or Kwixx Site.  You should promptly notify us if you become aware that any of your personal information which we hold is inaccurate or out-of-date where you are unable to correct the information using our Kwixx App or Kwixx Site.
If you wish to access, correct or delete any of your personal information which we hold that you are unable to access, correct or delete using our Kwixx App or Kwixx Site then please contact our Privacy Officer for assistance using the contact details below.  You will be required to verify your identity before our Privacy Officer will be able to assist you to access, correct or delete any of your personal information which we hold.  Our Privacy Officer will be able to assist you to access, correct or delete your personal information which we hold except to the extent that we are required or permitted by law to refuse to allow such access, correction or deletion.

If you have an enquiry or complaint about our handling of your personal information, please contact our Privacy Officer using the contact details below.  Our Privacy Officer is responsible for dealing with all enquiries and complaints about our handling of personal information.

We may update this Privacy Policy from time to time to take into account changes to our information handling practices by making available an updated version of this Privacy Policy on our Kwixx Site.  You should regularly review the current version of this Privacy Policy available on our Kwixx Site.
